CoinDonor – Terms of Service

These Terms of Service ("Terms") govern your access to and use of the CoinDonor website, applications, and related services (collectively, the "Platform").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use CoinDonor.


1. About CoinDonor

CoinDonor is a non-custodial cryptocurrency donation platform operated by CoinDonor LLC, a limited liability company registered in St. Kitts & Nevis ("CoinDonor," "we," "us," or "our").

CoinDonor provides software tools and interfaces that allow donors and recipients to interact directly on public blockchain networks.

CoinDonor does not act as a bank, money services business, financial institution, broker, exchange, custodian, trustee, or investment advisor.


2. Non-Custodial Nature of the Platform

CoinDonor is non-custodial by design. This means:

- CoinDonor never takes possession, custody, or control of any cryptocurrency.
- All donations are sent directly from the donor's wallet to the recipient's wallet on the relevant blockchain.
- CoinDonor does not receive, store, forward, escrow, or transfer funds on behalf of users.
- CoinDonor cannot access private keys, reverse transactions, freeze assets, or recover lost funds.

You acknowledge and agree that CoinDonor only provides technical infrastructure to facilitate peer-to-peer blockchain transactions.


3. Nature of Donations

- All donations are made exclusively in cryptocurrency.
- Blockchain transactions are irreversible once confirmed.
- CoinDonor does not guarantee that any donation qualifies as charitable or tax-deductible in any jurisdiction.
- Donors are solely responsible for verifying recipient addresses, networks, and eligibility before sending funds.
- All donations are made voluntarily and at your own risk.


4. Fees

CoinDonor charges a fixed annual subscription fee for access to and use of the Platform. The applicable fee, billing cycle, and renewal terms are disclosed at the time of signup or subscription renewal.

CoinDonor does not charge transaction-based, percentage-based, or per-donation fees, and does not deduct any amount from donated funds.

All cryptocurrency donations are transmitted in full from the donor's wallet directly to the recipient's wallet.

Blockchain network fees ("gas fees") may apply and are determined solely by the applicable blockchain network. CoinDonor does not set, control, receive, or profit from network fees.


5. User Responsibilities

You agree to:

- Use the Platform lawfully and in good faith.
- Ensure accuracy of wallet addresses, networks, and transaction details.
- Comply with all applicable laws, regulations, and sanctions in your jurisdiction.
- Accept all risks associated with cryptocurrency use, including volatility, congestion, protocol changes, and loss of access.

You must not use CoinDonor for:

- Money laundering or terrorist financing
- Sanctions evasion
- Fraud, deception, or unlawful activity


6. No Endorsement or Verification of Recipients

CoinDonor does not:

- Verify the legitimacy, legal status, or conduct of any recipient
- Guarantee that funds will be used for any stated purpose
- Monitor or control how recipients use donated funds

Any descriptions, profiles, or representations of recipients are provided by the recipients themselves.


7. Compliance and Monitoring

While CoinDonor is non-custodial, we reserve the right to:

- Implement reasonable compliance, sanctions, or risk-screening measures
- Restrict or block access to the Platform where required by law
- Cooperate with lawful requests from authorities

CoinDonor does not guarantee uninterrupted or error-free access to the Platform.


8. Assumption of Risk

You expressly acknowledge that:

- Cryptocurrency transactions are experimental and high-risk
- Errors in wallet addresses or network selection may result in permanent loss
- Smart contracts, wallets, or third-party services may fail
- You assume full responsibility for all transactions initiated through the Platform.


9. Limitation of Liability

To the fullest extent permitted by law, CoinDonor LLC shall not be liable for:

- Loss of funds, access, profits, data, or goodwill
- Blockchain failures, forks, bugs, or protocol changes
- User error, wallet mismanagement, or third-party actions
- Recipient misconduct or misuse of funds

CoinDonor's total liability, if any, shall not exceed the fees paid by you to CoinDonor in the preceding 12 months.


10. Indemnification

You agree to indemnify and hold harmless CoinDonor LLC, its officers, directors, employees, and affiliates from any claims, damages, losses, or expenses arising out of:

- Your use of the Platform
- Your violation of these Terms
- Your violation of any law or third-party rights


11. Intellectual Property

All content, branding, trademarks, and software associated with CoinDonor are the property of CoinDonor LLC or its licensors.

You may not copy, modify, distribute, or exploit any part of the Platform without prior written consent.


12. Suspension and Termination

We may suspend or terminate access to the Platform at any time, with or without notice, if:

- You violate these Terms
- We are required to do so by law
- Continued access poses legal or operational risk


13. Governing Law

These Terms are governed by the laws of St. Kitts & Nevis, without regard to conflict-of-law principles.

Any disputes shall be resolved exclusively in the courts of St. Kitts & Nevis.
